بيان شجب وإدانة بشأن الاعتداءات الخطيرة التي شهدتها محافظة البصرة

تتابع مؤسسة الإنصاف لحقوق الإنسان بإدانة قاطعة وموقف حازم لا يقبل التبرير أو التساهل ما شهدته محافظة البصرة في الأول من كانون الثاني 2026 من اعتداءات وانتهاكات سافرة طالت نواميس الناس وكرامتهم الإنسانية، رافقها ممارسات عنف وسلوكيات منافية للآداب العامة، في مشهد يمثّل طمسًا خطيرًا للكرامة الإنسانية وتدهورًا مقلقًا في البيئة المجتمعية، ويشكّل تهديدًا مباشرًا لأمن المجتمع وسلامه، ويستوجب أعلى درجات التعاطي والمسؤولية الرسمية والمجتمعية.

إن هذه الأفعال لا تمثّل مجرد تجاوزات فردية، بل تكشف عن ظاهرة اجتماعية وأمنية خطيرة تستدعي وقفة جادة وحازمة من جميع مؤسسات الدولة والقيادات المجتمعية وشيوخ العشائر، لما تحمله من اعتداء على الكرامة الإنسانية، وتقويض لهيبة القانون، وإشاعة مناخ من الخوف وعدم الأمان في الأماكن العامة، وتُعد دقًا واضحًا لجرس الإنذار حول ما آلت إليه حالة الانفلات السلوكي في الفضاءات العامة والفعاليات التي تفتقر إلى التنظيم القانوني.

وعليه، تطالب مؤسسة الإنصاف لحقوق الإنسان بما يأتي:
1. تشريع قانون خاص رادع يجرّم هذه الأفعال والانتهاكات بشكل صريح، ويقر عقوبات شديدة بحق كل من يثبت تورطه أو تواطؤه أو تقصيره في منعها، بما في ذلك تنظيم الحفلات والفعاليات العامة وفق ضوابط قانونية واضحة تتعلق بالأعمار، والمحتوى، وآليات الترخيص.
2. فتح تحقيقات شفافة وشاملة، ووضع جميع المتورطين تحت المساءلة القانونية دون استثناء، ابتداءً من الجهات التنفيذية المحلية في المحافظة، مرورًا بوزارة الداخلية، وصولًا إلى كل من له صلة مباشرة أو غير مباشرة بهذه الانتهاكات.
3. دعوة القيادات المجتمعية، وشيوخ العشائر، والمؤسسات التربوية والدينية، بما في ذلك الحوزة العلمية، وتحميلهم مسؤولية أخلاقية علنية في إعلان الموقف ورفض هذه الظواهر، والعمل على تعزيز ثقافة احترام الكرامة الإنسانية وصون الحقوق.
4. تحميل مجلس النواب العراقي المسؤولية الكاملة في تشريع قانون صارم ورادع يعالج هذه الظواهر بشكل مباشر وواضح، ومخاطبة منظمات حقوق الإنسان والجهات الإعلامية والمؤثرين لتحمّل دورهم المهني والإنساني في عدم الترويج أو التطبيع مع أي ممارسات تنتهك الكرامة الإنسانية.

إن السكوت عن هذه الأفعال يُعد تواطؤًا غير مباشر، ويكرّس مناخ الإفلات من العقاب، ويهدد النسيج الاجتماعي للعراق، ويقوّض ثقة المجتمع بمؤسساته.

وتؤكد مؤسسة الإنصاف لحقوق الإنسان أن حماية كرامة الإنسان، وصون أمن المجتمع والسلم الأهلي والأمن المجتمعي، ليست خيارًا بل واجبًا قانونيًا وأخلاقيًا، وأن مواجهة هذه الانتهاكات تتطلب موقفًا وطنيًا جامعًا يضع حدًا لهذا التدهور، ويعيد الاعتبار للحقوق التي كفلها الدستور.

(No neutrality in the face of violations of sanctities… silence is complicity)
Statement of Condemnation and Denunciation Regarding the Serious Assaults Witnessed in Basra Governorate

Al-Insaf Foundation for Human Rights follows, with outright condemnation and a firm stance that accepts no justification or leniency, the events witnessed in Basra Governorate on January 1, 2026, involving assaults and blatant violations that targeted people’s sanctities and human dignity. These were accompanied by violent practices and behaviors contrary to public morals, in a scene that represents a grave erasure of human dignity and an alarming deterioration of the social environment, posing a direct threat to community security and safety, and requiring the highest levels of official and societal responsibility and response.

These acts do not represent mere individual transgressions; rather, they reveal a dangerous social and security phenomenon that necessitates a serious and firm stand by all state institutions, community leaders, and tribal sheikhs, due to the assault on human dignity they entail, the undermining of the rule of law, and the spread of fear and insecurity in public spaces. They constitute a clear alarm bell regarding the state of behavioral breakdown in public spaces and events lacking legal regulation.

Accordingly, Al-Insaf Foundation for Human Rights calls for the following:

1. Enacting a specific, deterrent law that explicitly criminalizes these acts and violations and imposes severe penalties on anyone proven to be involved, complicit, or negligent in preventing them, including regulating public concerts and events under clear legal controls related to age limits, content, and licensing mechanisms.
2. Opening transparent and comprehensive investigations and placing all those involved under legal accountability without exception, starting with local executive authorities in the governorate, through the Ministry of Interior, and extending to anyone with a direct or indirect connection to these violations.
3. Calling upon community leaders, tribal sheikhs, and educational and religious institutions, including the religious seminary, and holding them publicly accountable on a moral level to declare their stance, reject these phenomena, and work to promote a culture of respect for human dignity and the protection of rights.
4. Holding the Iraqi Council of Representatives fully responsible for enacting a strict and deterrent law that directly and clearly addresses these phenomena, and addressing human rights organizations, media outlets, and influencers to assume their professional and humanitarian role in refraining from promoting or normalizing any practices that violate human dignity.

Silence regarding these acts constitutes indirect complicity, entrenches a climate of impunity, threatens Iraq’s social fabric, and undermines society’s trust in its institutions.

Al-Insaf Foundation for Human Rights affirms that protecting human dignity and safeguarding community security, civil peace, and societal safety is not an option but a legal and moral duty, and that confronting these violations requires a unified national stance that puts an end to this deterioration and restores respect for the rights guaranteed by the Constitution.
