تشريع الإعدام العنصري — وصمة عار في جبين الإنسانية

تُصدر مؤسسة الإنصاف لحقوق الإنسان هذا البيان بأشد العبارات وأكثرها وضوحاً وحزماً، في مواجهة هذا التصعيد الإجرامي غير المسبوق، مؤكدةً أن ما أقدم عليه الكنيست الإسرائيلي يُمثّل جريمة ضد الإنسانية بكل ما تحمله الكلمة من ثقل قانوني وأخلاقي.

صادق الكنيست الإسرائيلي بالقراءة الثانية والثالثة النهائية على قانون إعدام الأسرى الفلسطينيين، بأغلبية 62 صوتاً مقابل 48 صوتاً معارضاً، وبمباركة صريحة من رئيس حكومة الاحتلال بنيامين نتنياهو الذي صوّت شخصياً لصالحه.

يقضي هذا القانون الإجرامي بفرض عقوبة الإعدام على كل فلسطيني يُدان بتنفيذ عملية أدت إلى مقتل إسرائيليين، مع حظر منح أي عفو في هذه الحالات وتثبيت الحكم دون إمكانية تخفيفه، على أن تكون العقوبة إلزامية دون اشتراط إجماع قضائي، وينفَّذ حكم الإعدام شنقاً خلال فترة لا تتجاوز 90 يوماً.
إن الطابع العنصري لهذا القانون لا يقبل التأويل، إذ يُوجَّه أساساً ضد الأسرى الفلسطينيين المتهمين بقتل إسرائيليين في عمليات توصف بأنها ذات دوافع قومية، بينما لا يشمل السجناء اليهود المتهمين بقتل فلسطينيين، فيُؤسس بذلك لنظامين قضائيين مختلفين لليهود والعرب، مما يعكس تمييزاً عنصرياً سافراً يُعرّفه القانون الدولي صراحةً بوصفه نظام تمييز عنصري ممنهج.

وفي الوقت الذي تواصل فيه حكومة الاحتلال الإسرائيلي توفير الحماية لعصابات المستوطنين الإرهابيين المتورطين في قتل الفلسطينيين والإفراج عنهم رغم ثبوت جرائمهم، فإنها تمضي في إقرار تشريعات الإعدام بحق أسرى الحرية الفلسطينيين الذين يناضلون دفاعاً عن أرضهم، وهي ازدواجية فاضحة تكشف الجوهر العنصري الحقيقي لهذه المنظومة وتُعرّي زيف ادعاءاتها الديمقراطية.

تُطالب مؤسسة الإنصاف لحقوق الإنسان بإدانة فورية وصريحة لهذا القانون من جميع حكومات العالم ومنظمات حقوق الإنسان الدولية، وتُؤكد أن بيانات القلق وحدها لم تعد كافية ولا مقبولة، وأن المطلوب هو تحريك المحكمة الجنائية الدولية والمحاكم الأممية لوقف تنفيذه فوراً، وفرض عقوبات سياسية وقانونية ودبلوماسية حقيقية على دولة الاحتلال، وضمان الحماية الكاملة لجميع الأسرى الفلسطينيين بموجب اتفاقيات جنيف وسائر الشرائع الدولية، مع التأكيد الجازم على أن الصمت على هذا القانون يُشكّل تواطؤاً مباشراً مع منظومة عنصرية تُشرّع القتل على أساس الهوية القومية.

إن الأسرى الفلسطينيين أصحاب الأرض والتاريخ والحق الذي لا يُصادَر لن تُخيفهم مشنقة ولا قانون، فشعب صمد في وجه آلة الإبادة عقوداً لا تُثنيه تشريعات الجلادين. وإننا نُخاطب العالم بصوت لا يقبل الصمت: إن التاريخ لم يرحم يوماً من سنّوا قوانين القتل على أساس العرق والهوية، وكل من صوّت لهذا القانون الإجرامي وكل من نفّذه سيقف يوماً أمام محاكم العدالة خاسئاً ذليلاً، لأن دماء الأحرار لا تذهب هدراً، والظلم مهما طال فإن نهايته زوال.

Racist Execution Legislation — A Stain on the Face of Humanity
The Al-Insaaf Foundation for Human Rights issues this statement in the strongest, clearest, and most firm terms against this unprecedented criminal escalation, affirming that the Israeli Knesset’s action represents a crime against humanity in every legal and moral sense of the word.
The Israeli Knesset has passed the final second and third readings of the law to execute Palestinian prisoners, with a majority of 62 votes to 48, and with the explicit blessing of the occupation’s Prime Minister, Benjamin Netanyahu, who personally voted in favor of it.
This criminal law mandates the death penalty for any Palestinian convicted of carrying out an operation resulting in the death of Israelis. It prohibits granting any pardons in these cases and fixes the sentence without the possibility of reduction. The penalty is mandatory without requiring judicial consensus, and the execution—by hanging—must be carried out within a period not exceeding 90 days.
The racist nature of this law is indisputable, as it is primarily directed against Palestinian prisoners accused of killing Israelis in operations described as having nationalistic motives, while excluding Jewish prisoners accused of killing Palestinians. It thus establishes two separate judicial systems for Jews and Arabs, reflecting blatant racial discrimination explicitly defined by international law as a systematic apartheid system.
At a time when the Israeli occupation government continues to provide protection to terrorist settler gangs involved in killing Palestinians and releases them despite proven crimes, it proceeds to approve execution legislation against Palestinian freedom fighters struggling in defense of their land. This flagrant double standard exposes the true racist core of this system and strips away its false democratic claims.
The Al-Insaaf Foundation for Human Rights demands an immediate and explicit condemnation of this law by all world governments and international human rights organizations. It emphasizes that statements of concern are no longer sufficient or acceptable; what is required is the mobilization of the International Criminal Court and UN courts to halt its implementation immediately. Real political, legal, and diplomatic sanctions must be imposed on the occupation state, ensuring full protection for all Palestinian prisoners under the Geneva Conventions and other international laws, while firmly asserting that silence regarding this law constitutes direct complicity with a racist system that legislates killing based on national identity.
The Palestinian prisoners—the owners of the land, history, and inalienable rights—will not be intimidated by a gallows or a law. A people who have withstood the machinery of genocide for decades will not be deterred by the legislation of executioners. We address the world with a voice that refuses silence: history has never been kind to those who enacted laws of murder based on race and identity. Everyone who voted for this criminal law and everyone who implements it will one day stand before the courts of justice, defeated and humiliated, for the blood of the free is never shed in vain, and however long injustice lasts, its end is inevitable.
